Pay Review Update – September 2025

Dear Mosaic Disability Support Workers, past and present,

We’re writing to provide you with an important update on Mosaic’s Pay Review Project.

As you may be aware, Mosaic self-reported historic payroll discrepancies to the Fair Work Ombudsman (FWO) in April 2024. Since then, we’ve been working diligently to ensure that every impacted employee (including former employees) receive the correct entitlements.

Resolution of Sleepover Shift Dispute

In our last update we advised that HACSU had raised a dispute with Mosaic regarding the rostering of sleepover shifts under the Mosaic 2022 Enterprise Agreement. At the time, this dispute prevented us from progressing certain calculations under that Enterprise Agreement.

We’re pleased to share that HACSU has now withdrawn the dispute and that the Payroll Review Project Team are able to continue with finalising calculations.

Progress Since Our Last Update

We’ve continued recalculating pay entitlements for current and former employees, including six years’ worth of timesheets. To put it in perspective, this means reviewing and recalculating hundreds of thousands of shifts (approx. 900,000 lines of data) across six years which is a complex and detailed process that takes time to get right.

Since our last update in April 2025, we’ve made significant progress:

  • Our external advisors have developed a comprehensive model to calculate entitlements under the STAR, Mosaic 2019, and Mosaic 2022 Enterprise Agreements.

  • We’ve been reviewing and testing this model to ensure accuracy and compliance We are currently focussing on Mosaic EA2019 which is the biggest part of the review activity. Initial testing of these calculations has been positive.

  • We continue to meet regularly with the Fair Work Ombudsman to share our progress and discuss challenges. Our most recent meeting with the FWO was last month.

Summary of Issues Identified

A reminder that our review has identified a number of historic payroll discrepancies, including:

Significant issues – all periods

  • Broken shifts - application of double time after a 12-hour span

  • Minimum rest breaks after overtime - application of double time

  • Annual leave accrual - additional week of leave (pro-rata) where Community Access workers have met shift-worker criteria

Minor issues

  • Broken shifts - penalty rates based on the finishing time of the shift between Feb 2022 and May 2023

  • Overtime – application of daily and shift overtime between Aug 2019 and Apr 2024

  • Overtime – application of period overtime where paid leave was taken between Aug 2019 and Apr 2024

  • Higher duties allowance – overpayments of salary maintenance between Jun 2023 and Apr 2024

  • Sleepover shifts - application of minimum 4 hours paid between Aug 2019 and May 2023

  • Sleep disturbances application of minimum overtime hours between Aug 2019 and May 2023

  • Paid breaks – payment for breaks between shifts less than 30 minutes between Aug 2019 and Apr 2024

What’s Next

  • Final testing and auditing of the calculation model is underway.

  • Once complete, we’ll have a clear understanding of individual pay liabilities.

  • We hope to have the calculations finalised soon, and following an audit, we anticipate making payments in the first quarter of 2026.

We understand this process has taken longer than expected, however a number of modifications to the model and retesting have delayed our original timeframe, we appreciate your patience. Our priority remains ensuring accuracy and fairness for every employee.
